SARS-CoV-2 koronabirusaren etorrerak eta hari lotutako gaixotasunak –Covid-19– agerian uzten du munduko osasun-sistemaren ahultasuna eta, gainera, eztabaida zahar bat indarberritzen du, non, nolabait, farmazia-industriak –gaixotasuna tratatzeko txertoak eta sendagaiak garatu dituelako edo garatzen ari delako, eta bere lana saritu dadin nahi duelako– eta, oro har, herritarrak –emaitza horien hartzaile gisa, koronabirusarekin lotutako prebentzioeta arintze-tratamenduetarako sarbide azkarra, zuzena eta bidezkoa eskatzen dutelako– aurrez-aurre dauden. Ikerketa honek pandemiaren egungo testuingurua aztertzen du, ikuspegi faktikotik zein juridikotik, eta, horretarako, antzeko konnotazioak dituzten aurreko esperientziak berrikusten dira eta esku hartzen duten eragileen arteko tentsioak lasaitzeko eskura dauden lege-tresnak aztertzen dira.
The SARS-CoV-2 coronavirus and its associated disease –Covid-19– highlights the weakness of the global health system and entails an strong resurgence of a long-running debate in which the pharmaceutical industry –which has developed or is developing vaccines and drugs to treat the disease and intends to see its work rewarded– faces the general public who, as the recipient of such results, demand prompt, fair and equitable access to preventive and palliative treatments related with the coronavirus. This paper analyzes, both from a factual and legal level, the current context of the pandemic and with this purpose it makes a review of previous experiences with similar connotations and studies the legal instruments available to lessen the tensions between the relevant actors.
